Condition/Rules
for Name Reservation
|
Application for reservation of a name is made on-line or using Form 2 (F-2). The
reservation request states the full names, address of the applicant, and proposes
three (3) names for the organization to be registered.
The proposed 3 names should be in order of priority. Upon reservation of a name,
the applicants is required to pay a name search fee of Kenya shillings five hundred
(KES 500) within fourteen (14) days from the date of reservation. Once a name has
been approved, it is reserved for a period of sixty (60) days.
An applicant can
renew the reservation on the expiry of the name reservation period for a further
sixty (60) days on payment of a further Kenya Shillings Five hundred (KES 500).
The Name Reservation Process
(Name Search)
Name search is the initial activity to be conducted before registration application
documents can be lodged. The duly approved Name Reservation Form (F2) must be provided
as proof that a name has been reserved before registration documents can be accepted.
For name reservation done online, this form will be provided to the applicant once
payment has been done.
In considering the name reservation applications, the following name proposals shall be rejected:
a) Those that are similar in entirety to a name already existing in the register except in instances where the organization
is sponsored by an existing organization as a chapter or branch;
b)
Those that have three initial words that are similar to an existing name on the register;
c)
Those whose names are similar to that of an existing government department or existing and legally registered organization;
d) Those which make derogatory or offensive reference to a particular community, group of people or religion;
e) Those whose names suggest or make reference to an intention to evangelize or propagate the faith;

f) Those whose acronym
is similar to an existing name or acronym in the register;
g. Those that when shortened might have similarity with an existing acronym or name in the register;
h) Those whose meaning appear unclear except in instances where the organization is registered elsewhere outside the country to carry out the work of an NGO, or Charity;
i) Those that involve an amalgamation of the names of individuals;
j) Those who seek to use individuals’ names without their written consent and or that of their families;
k) Where the proposed name is already in existence.
Where the meaning of a proposed name is not clear, the organization will be asked to state the meaning.
Where an existing organization wishes to establish a new chapter, it shall make a written request addressed to the Executive Director, ETrs Co-ordination Board
stating as such. This should be accompanied
by a letter of sponsorship from the parent organization. Such an organization will
be allowed to add a suffix to its name to distinguish it from relationship of the
sponsoring organization but at the same time define its identity as a separate organization.
Please note however, that under the ETrs Coordination Act of 1990 such chapters
are legal entities in themselves and are therefore solely liable under the law.
If the approved name includes the suffix
Kenya, East Africa, Africa, Regional or any other term that may denote activities outside the jurisdiction
of Kenya then the NGO is automatically international in scope
